GDPR Consent for existing user

Do we, as a data processor, have to gain consent from our existing users, or we can just inform them about updating our privacy policy and present them with their rights?

Answer:

If you are a data processor it means that you are processing personal data on behalf of a data controller and it is the data controller not the processor which is in charge of establishing a lawful basis for processing personal.

Hello Andrei,

Thank You for the answer.
I have another question regarding consent. Can we send our existing users info about our update of privacy policy and give them option, if they don't agree with terms presented there, to unsubscribe or delete their account, or to accept those terms, and give them option to agree and it that way get consent?

Thank you.
Best regards,
Nevio Rugas

Consent forms and Privacy Notices are different things. The consent form is to be used to get the consent of the individuals for certain processing activities such as direct marketing, privacy notices on the other hand are meant to inform the individuals about the a certain processing activity.

Another difference is that privacy notices are just to be presented to the data subjects the data subject does not need to agreed to them.
